Welcome to OpenRate98. These Terms of Service govern your access to and use of OpenRate98, available at https://openrate98.xyz.

By creating an account, purchasing a plan, using the platform, importing data, exporting leads, or accessing any OpenRate98 feature, you agree to these Terms.

If you do not agree, please do not use OpenRate98.

1. About OpenRate98

OpenRate98 is a lead generation and outreach management platform that helps users:

  • Create business lead campaigns
  • Collect publicly available business information
  • Organize leads in a dashboard
  • Verify WhatsApp availability where possible
  • Store CRM notes and follow-up activity
  • Import and export campaign data
  • Manage lead credits, subscriptions, and referral rewards

OpenRate98 does not guarantee sales, replies, business outcomes, WhatsApp availability, data accuracy, or campaign performance.

2. Eligibility

You must be legally able to enter into a binding agreement to use OpenRate98.

You may not use OpenRate98 if:

  • You are prohibited from using the service by law
  • You are under the minimum legal age required in your location
  • Your account was previously suspended or terminated for abuse
  • You intend to use the platform for unlawful, harmful, deceptive, or spam-related activity

3. Account Registration

To use OpenRate98, you may need to create an account.

You agree to:

  • Provide accurate account information
  • Use a real, working email address
  • Keep your login credentials secure
  • Complete email verification when required
  • Complete phone or WhatsApp verification when required
  • Not create duplicate accounts to abuse free credits
  • Not share your account with unauthorized users
  • Notify us if you suspect unauthorized account access

We may suspend or restrict accounts that appear fake, abusive, duplicate, suspicious, or created to bypass usage limits.

4. Subscriptions, Plans, and Lead Credits

OpenRate98 may offer free and paid plans.

Lead credits represent collected business phone-number leads, not guaranteed WhatsApp numbers.

Your plan may include limits such as:

  • Monthly lead credits
  • Total free credits
  • Campaign creation limits
  • CSV import limits
  • Search limits
  • Feature access limits
  • Top-up eligibility

Monthly credits may reset each billing cycle unless otherwise stated. Unused monthly credits do not automatically roll over unless specifically offered in writing.

We may change plan limits, pricing, or package structure in the future. Changes will not remove credits already purchased unless required due to fraud, abuse, chargebacks, or violation of these Terms.

5. Free Plan and Abuse Prevention

The free plan is intended for testing OpenRate98.

You may not abuse free credits by:

  • Creating multiple accounts
  • Using disposable or temporary email addresses
  • Reusing referral links for fake accounts
  • Using automated signup tools
  • Sharing devices or IP patterns to bypass limits
  • Attempting to reset or manipulate usage limits
  • Importing or generating leads in a way that violates account restrictions

OpenRate98 may use email verification, phone verification, device signals, IP checks, manual review, and other abuse-prevention methods to protect the platform.

We may deny, reduce, pause, or remove free credits if abuse is suspected.

6. Payments and Billing

Paid subscriptions and lead top-ups may be processed through third-party payment providers such as Stripe.

By purchasing a plan or top-up, you agree to pay the listed price and any applicable taxes or fees.

You are responsible for keeping your billing information accurate and up to date.

Subscription access may be paused, downgraded, or canceled if payment fails.

7. Refunds

Unless required by law or separately agreed in writing, payments for subscriptions, lead credits, and top-ups are generally non-refundable once access or credits are issued.

We may consider refund requests case by case, especially for duplicate charges, billing errors, or technical failures that prevent platform access.

8. Lead Data and Data Accuracy

OpenRate98 may collect or organize business data from public sources and third-party services.

Lead data may include:

  • Business name
  • Phone number
  • Website
  • Address
  • City or region
  • Google Maps link
  • Rating and review count
  • Email address when publicly available
  • WhatsApp verification status
  • CRM notes and follow-up information

We do not guarantee that lead data will be complete, accurate, current, deliverable, contactable, or suitable for your specific purpose.

You are responsible for reviewing and validating lead data before using it.

9. WhatsApp Verification

OpenRate98 may help you check whether a business phone number appears to be available on WhatsApp.

WhatsApp availability may vary and may not always be accurate.

A confirmed WhatsApp number does not guarantee:

  • A response
  • A sale
  • A valid owner contact
  • Permission to message
  • Continued WhatsApp availability

OpenRate98 is not affiliated with WhatsApp or Meta.

You are responsible for using WhatsApp according to WhatsApp’s terms, local laws, and respectful communication practices.

10. Email Discovery

OpenRate98 may attempt to discover email addresses from public websites or other public sources.

We may filter out invalid, placeholder, disposable, system-generated, or irrelevant email addresses where possible.

However, we do not guarantee that discovered emails are accurate, deliverable, monitored, or lawful to contact.

You are responsible for complying with email marketing, privacy, anti-spam, and data protection laws.

11. User Responsibilities

You agree to use OpenRate98 lawfully and responsibly.

You must not use OpenRate98 to:

  • Send spam
  • Harass, threaten, or abuse anyone
  • Violate privacy, marketing, or communications laws
  • Scrape, collect, or process data unlawfully
  • Misrepresent your identity or business
  • Sell or distribute data illegally
  • Upload malicious files or code
  • Attempt to hack, reverse engineer, overload, or disrupt the platform
  • Bypass payment, subscription, credit, or security systems
  • Use automation to abuse the platform
  • Violate third-party terms or platform policies

You are solely responsible for your outreach messages, campaign strategy, exported data, compliance practices, and business results.

12. Compliance With Laws

You are responsible for complying with all laws and regulations that apply to your use of OpenRate98, including laws related to:

  • Privacy
  • Data protection
  • Marketing
  • Spam
  • Telemarketing
  • WhatsApp messaging
  • Email outreach
  • Consumer protection
  • Business communications

This may include laws such as GDPR, CCPA/CPRA, CAN-SPAM, TCPA, PECR, CASL, and similar local regulations where applicable.

OpenRate98 does not provide legal advice.

13. Imported Data

If you upload CSV files or other data, you confirm that:

  • You have the legal right to upload and use that data
  • The data does not violate third-party rights
  • The data does not include unlawful, sensitive, harmful, or prohibited content
  • Your use of the data complies with applicable laws

We may reject, limit, or remove imported data if it appears abusive, unsafe, unlawful, or technically harmful.

14. Referrals and Rewards

OpenRate98 may offer referral rewards.

Referral rewards may depend on:

  • A referred user signing up through your referral link
  • The referred user purchasing a qualifying paid plan
  • Payment being successfully verified
  • The referral not being fraudulent, duplicate, self-referred, or abusive

We may review referrals manually before issuing rewards.

We may deny, reverse, or remove referral credits if we detect abuse, duplicate accounts, fake accounts, chargebacks, refund abuse, or suspicious referral patterns.

Referral reward amounts may change in the future.

15. Account Suspension or Termination

We may suspend, restrict, or terminate your account if:

  • You violate these Terms
  • Payment fails
  • You abuse free credits or referrals
  • You create duplicate or fake accounts
  • You use disposable emails or false information
  • Your activity creates security, legal, or operational risk
  • You attempt to bypass platform restrictions
  • We are required to do so by law

If your account is terminated for abuse or violation, unused credits may be forfeited.

16. Platform Availability

We aim to keep OpenRate98 reliable, but we do not guarantee uninterrupted availability.

The platform may be unavailable due to:

  • Maintenance
  • Updates
  • Hosting issues
  • Third-party service outages
  • API limits or pricing changes
  • Security incidents
  • Force majeure events
  • Technical failures

We are not responsible for losses caused by temporary downtime, delayed processing, incomplete searches, or third-party service interruptions.

17. Third-Party Services

OpenRate98 may depend on third-party services such as:

  • WordPress
  • Stripe
  • Google services or APIs
  • Wordfence or security tools
  • Hosting providers
  • Email delivery services
  • Analytics or monitoring tools

Your use of OpenRate98 may also be subject to those providers’ terms and policies.

We are not responsible for third-party service errors, outages, pricing changes, policy changes, or data limitations.

18. Intellectual Property

OpenRate98, including its platform design, features, branding, software, content, workflows, and related materials, is owned by OpenRate98 or its licensors.

You may not copy, resell, reproduce, modify, reverse engineer, or create competing products from OpenRate98 without written permission.

You retain ownership of data you upload, but you grant us permission to process it as needed to provide the service.

19. Feedback and Feature Requests

If you submit feedback, ideas, suggestions, or feature requests, you allow us to use them without restriction or compensation.

We may choose whether or not to implement requested features.

20. Disclaimers

OpenRate98 is provided on an “as is” and “as available” basis.

We make no guarantees that:

  • Leads will be accurate
  • Phone numbers will be WhatsApp-ready
  • Emails will be valid
  • Campaigns will generate replies
  • You will make sales or revenue
  • Data will always be complete or current
  • The platform will be error-free or uninterrupted

You use OpenRate98 at your own risk.

21. Limitation of Liability

To the maximum extent permitted by law, OpenRate98 will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages.

This includes losses related to:

  • Lost revenue
  • Failed campaigns
  • Incorrect lead data
  • Messaging restrictions
  • Account suspension
  • Third-party service outages
  • Payment provider issues
  • Data loss
  • Compliance violations by users

Our total liability for any claim will not exceed the amount you paid to OpenRate98 in the three months before the claim, or $100 if you used only a free account.

22. Indemnification

You agree to defend, indemnify, and hold harmless OpenRate98 from claims, damages, penalties, losses, liabilities, and expenses arising from:

  • Your use of the platform
  • Your outreach activity
  • Your violation of these Terms
  • Your violation of laws or third-party rights
  • Your imported or exported data
  • Your messages, campaigns, or business practices
  • Your misuse of lead data

23. Changes to These Terms

We may update these Terms from time to time.

If changes are significant, we may notify users through the website, dashboard, email, or another reasonable method.

Continued use of OpenRate98 after updated Terms are posted means you accept the updated Terms.
